Sale of Goods Terms

These terms relate to items supplied to you through the www.cornwallonview.com website (“the Website”) and should be read in conjunction with the Terms and Conditions which shall also apply.

  • 1. Prices

    • The prices payable for the photographs that you order are clearly set out on the Website. If by mistake, we have underpriced an item, we will not be liable to supply that item to you at the stated price provided that we notify you before we dispatch the item concerned, provided that we notify you before payment is made

    • 1.2 We reserve the right to review the price of any item at any time.

    • 1.3 All prices are expressed inclusive of any VAT payable unless otherwise stated.

  • 2. Ordering / Availability

    • 2.1 When placing an order, your details will automatically be passed to PayPal in order to process your payment for the items. Once PayPal has processed your payment and sent confirmation of payment to us, then we shall dispatch via email a link to the file which is only accessible via your secure account with us.

    • 2.2 The link to the file allows for five download attempts which must be performed within seven days of receiving the link. We accept no responsibility in the event that you are unable to download the item or cannot do so within seven days, except where the failure to download was caused due to our fault.

    • 2.3 If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you except to ensure that you are not charged for that item.

  • 3. Delivery of the item

    • 3.1 The link to the items shall be delivered to the email address you provided to us within 3 days.

    • 3.2 Whilst we make every effort to ensure that the link is delivered within the time detailed in 3.1 above, we will not be liable if we fail to do so due to circumstances beyond our control.

    • 3.3 When ordering the items you shall be given the option to receive the item on CD-Rom via the post. If you chose to receive the item via this method you may be liable to an extra charge for the CD-Rom, postage and packing, this will be communicated to you before the order is dispatched.

    • 3.4 If you have requested that the item is sent to you on CD-Rom, we shall use reasonable endeavours to dispatch your item to you within [ ] days of receipt of your order. We shall not be liable to you if we fail to do so within these time limits.

    • 3.5 In the event that we are unable to comply with the time limits in clauses 3.1 and 3.4, we shall contact you in order to inform you of the changes to the time limits.

  • 4. Access to the Website

    • 4.1 In consideration of the payment of the price we hereby grant to you a non-exclusive licence to use the item on one occasion for commercial purposes subject this clause 4.

    • 4.2 In the event that you wish to use the item for more than one purpose, you must contact us in writing in order to request permission. It shall be at our sole discretion as to whether to allow the use of the item for more than one purpose.

    • 4.3 It is a condition of the licence that you shall name the photographer of each item in an appropriate location on all reproductions of the item.

    • 4.4 You may not alter or modify the item in any way unless you obtain prior written permission from us. We reserve the right to refuse to allow an alteration or modification for any reason.

    • 4.5 The item must be reproduced accurately and not used in a misleading context.

    • 4.6 The copyright in the item remains with us [and all intellectual property notices must appear on all copies].

  • 5. Purchasers

    The Website is intended to promote Cornwall and assist businesses in obtaining images of Cornwall for use in business literature. The items are intended to be used by businesses only and are not available for purchase by consumers.

  • 6. Governing Law

    All purchases from www.cornwallonview.com shall be governed and construed in accordance with English Law.
